LEED CS v2009 certified building

Hi all, We have a small LEED:CI project in a CS certified shopping mall. We don't have any direct outdoor air intakes, we take the air from the main atrium and give it to our space.

If we have a LEED Project that was pursuing a Pilot Credit but without knowing that it was a Pilot Credit, and are at the Submission Phase can we still apply for this credit.
